2 Tests Used by the WRC in Constructive Dismissal Claims

Constructive dismissal is where the employee quits the job due to the unreasonable conduct of the employer.

So if you as employer don’t fire your employee, you would be mistaken thinking that you can’t lose an unfair dismissal case. It will just have a slightly different „name”-constructive dismissal.
Anyway, the WRC and Courts will apply 2 tests in deciding the case. 

If you don’t fail these 2 tests you will win and successfully defend a claim. If you fail you will be paying out.
